Die Form der Betriebsanleitungen (also auf Papier oder digital) ist bislang in der Maschinenrichtlinie 2006/42/EC nicht geregelt. Der rechtlich nicht bindende Leitfaden für die Anwendung der Maschinenrichtlinie sieht in §255 die digitale Form lediglich als Ergänzung zur führenden Papierform an. Viele Marktaufsichtsbehörden folgen der veralteten Ansicht des Guides, so dass viele Unternehmen sich aufgrund der unklaren Rechtslage erst einmal gegen die digitale Bereitstellungsform entscheiden.

Die Europäische Kommission hat am 21. April einen ersten Entwurf für die neue Maschinenverordnung veröffentlicht. Dieser Entwurf enthält in Anhang III eine spezielle Regelung für Anleitungen in digitaler Form. Dies ist eine völlige Abkehr von der bisher im Leitfaden zur Anwendung der Maschinenrichtlinie 2006/42/EG - Ausgabe 2.2 vertretenen Auffassung.

 

The form of the operating instructions (i.e. on paper or digitally) has not yet been regulated in the Machinery Directive 2006/42/EC. In §255, the legally non-binding Guide for the Application of the Machinery Directive sees the digital form merely as a supplement to the leading paper form. Many market surveillance authorities follow the outdated view of the guide, meaning that many companies decide against the digital provision form for the time being due to the unclear legal situation. The European Commission published an initial draft of the new Machinery Regulation on April 21. This draft contains a special regulation for instructions in digital form in Annex III. This is a complete departure from the view previously expressed in the Guide to the Application of the Machinery Directive 2006/42/EC - Edition 2.2.

Biography

Claudia Klumpp ist studierte Juristin und Betriebswirtin. Nach mehrjähriger Tätigkeit als Rechtsanwältin und Rechtsberaterin ist sie seit 2013 bei den Fachverbänden tekom Deutschland und dem europäischen Verband für Technische Kommunikation – tekom Europe.

 

Claudia Klumpp holds a degree in law and business administration. After working as a lawyer and legal advisor for several years, she has been with the trade associations Gesellschaft für Technische Kommunikation – tekom Deutschland and the European Association for Technical Communication – tekom Europe since 2013. She oversees the standardization work of both associations at both the national and international level. Since 2020, Claudia has been deputy managing director of tekom Deutschland. She also lectures on legal and normative requirements for technical communication for students at Karlsruhe University of Applied Sciences.
